TB3 Log / App Terms of Use
TB3 Log App Terms of Use
Last updated: October 2026
These App Terms of Use ("Terms") are a legal agreement between TB3 LOG CORP, a Florida corporation (Florida document no. P26000036331) ("TB3 Log", "we", "us" or "our"), and the merchant that installs or uses the TB3 Log app for Shopify ("you"). They govern how you may install and use the app. Please read them carefully: they include a disclaimer of warranties, a limitation of liability and an indemnity. Shopify is not a party to these Terms.
1. About these Terms
By installing, accessing or using the App, or by accepting these Terms in the App or in your Service Agreement, you agree to these Terms, including the Data Processing Addendum incorporated in Section 10. If you accept on behalf of a company, you confirm that you have authority to bind it, and "you" means that company. If you do not agree, do not install or use the App.
The App is intended for businesses, not for consumers. These Terms apply however the App is made available to you: as a custom app created for your store and installed through a link that we send you, or as a public app on Shopify, including one available only through a direct link. The current version of these Terms is always available at https://tb3log.com/app-terms.
2. Key terms
- "App" means the TB3 Log app for Shopify (also called "TB3 Log for Shopify"), including its screens in your Shopify admin, its connection to TB3 Log's systems, its documentation and any updates.
- "Services" means the logistics and fulfillment services that TB3 Log provides to you, such as receiving, storage, pick and pack, shipping and returns.
- "Service Agreement" means your quote or service agreement with TB3 Log for the Services, together with the TB3 Log Terms of Service at https://tb3log.com/terms.
- "Store" means each Shopify store on which you install the App.
- "Recipients" means the people to whom your orders are shipped, usually your customers.
- "Merchant Data" means any information relating to you or your Store, including your orders and the personal data of your customers and other Recipients, that TB3 Log receives through the App or Shopify's APIs.
- "DPA" means the TB3 Log Data Processing Addendum at https://tb3log.com/dpa.
- "Shopify" means Shopify Inc. and its affiliates, which operate the Shopify platform.
3. How the App works
The App connects your Store to TB3 Log's fulfillment center in Miami, Florida:
- Orders that your Store routes to TB3 Log, according to the settings agreed with us, reach the App.
- Our team picks, packs and ships them, using the order details in TB3 Log's internal system.
- The App sends the carrier, the tracking number and the tracking link back to your Store.
- Shopify marks the order as fulfilled and, depending on your Store's notification settings, notifies your customer.
Shipping notifications to your customers are sent by Shopify, not by TB3 Log, based on your settings.
4. The App and your Service Agreement
The App is a tool for using the Services. These Terms govern the installation and use of the App and the data it handles. The Services themselves, including prices, receiving, storage, handling, shipping, returns, insurance, loss of or damage to goods and invoicing, are governed by your Service Agreement, including the TB3 Log Terms of Service at https://tb3log.com/terms.
The App is offered only to merchants that have an active Service Agreement with TB3 Log. Installing the App does not by itself create a Service Agreement or oblige TB3 Log to provide Services.
Order of precedence. If these Terms and the Service Agreement conflict, these Terms prevail on matters about the App, and the Service Agreement prevails on matters about the Services. The DPA prevails on the processing of personal data. Section 5 and the paragraph below prevail over any conflicting provision of the Service Agreement or of any other agreement between you and TB3 Log.
No exclusivity or non-compete. Nothing in these Terms or in the Service Agreement (a) requires you to use TB3 Log exclusively after the relevant agreement ends; (b) prevents you from developing, marketing or distributing products or services that compete with the App or the Services, except that you may not use TB3 Log's confidential information without our permission; or (c) restricts your ability to freely conduct your business or to do business with any customers, clients or employees. This does not affect the rules in these Terms and in the Service Agreement on how the App and the Services may be used.
5. Shopify's role
The App works with Shopify, but it is developed, operated and supported by TB3 Log, an independent company. Shopify is not a party to these Terms, which are between you and TB3 Log only. Shopify is a trademark of Shopify Inc.
You acknowledge and agree that: (i) TB3 Log is solely responsible for the App; (ii) Shopify is not liable for any fault in the App or any harm that may result from its installation or use; (iii) except where expressly stated by Shopify, Shopify cannot provide assistance with the installation or use of the App; and (iv) TB3 Log is solely responsible for any liability which may arise from your access to or use of the App, including (A) the development, use, marketing or distribution of, or access to, the App, including support of the App, and (B) TB3 Log's access to, use, distribution or storage of Merchant Data.
You also acknowledge and agree that, to the fullest extent permitted by law:
- Shopify makes no representations or warranties about the App and disclaims all warranties relating to it, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
- Shopify will not be liable to you for any direct, indirect, incidental, special, consequential, punitive, exemplary or other damages of any kind that result from or relate to the App or to your relationship with TB3 Log, even if Shopify has been advised of the possibility of such damages.
- Your relationship with TB3 Log is strictly between you and TB3 Log. Shopify is not obligated to intervene in any dispute between you and TB3 Log.
- Shopify may change, limit or discontinue its platform and APIs, may review, suspend or remove the App, and may suspend or end TB3 Log's access to its APIs, at any time and under its own terms with TB3 Log. Any of these may affect the App or stop it from working, and Shopify has no liability to you for it. We will tell you as soon as practicable if this happens.
- Your use of Shopify is governed by your own agreement with Shopify, which these Terms do not change. You remain responsible for complying with it when you use the App.
- For help with the App, you should contact TB3 Log, not Shopify (see Section 12).
Shopify is an intended third-party beneficiary of this Section 5 and of Section 17, and may enforce them directly.
6. Price
The App is free to install and use. We do not charge for the App, through Shopify or otherwise.
The Services are charged separately, under your Service Agreement and the TB3 Log Terms of Service at https://tb3log.com/terms. Those charges are for logistics services, not for the App, and are invoiced directly by TB3 Log. Shopify does not bill or collect them.
If we decide to charge for the App in the future, we will give you at least 30 days' notice, as described in Section 13. A charge for the App will apply only after you approve it, and it will be billed through Shopify's billing system whenever Shopify requires it.
7. License to use the App
Subject to these Terms, TB3 Log grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the App on your Stores, while these Terms are in effect, only to use the Services and manage your orders with TB3 Log.
You may not, and may not allow others to:
- copy, modify, translate or create derivative works of the App;
- reverse engineer, decompile or disassemble the App, except to the extent the law expressly permits it;
- sell, rent, lend, sublicense or otherwise make the App available to anyone other than your own staff and the contractors working for you;
- bypass or interfere with the App's security, access controls or normal operation, or try to access other merchants' data;
- use the App in breach of the law, of Shopify's terms and policies, or of anyone's rights.
TB3 Log and its licensors own the App, including its software, design and documentation, and the TB3 Log name and logo. These Terms do not transfer any ownership to you. If you send us suggestions about the App, we may use them freely, without any obligation to you.
8. What you authorize
The App can access your Store only with the permissions that you approve on Shopify's installation screen. Those permissions cover orders, fulfillment orders, fulfillments and fulfillment services. The App does not request access to your products or customer list. Order permissions also cover payment details; the App uses only whether an order is paid and does not read card or other payment details. By installing the App and accepting these Terms, you authorize TB3 Log to:
- Read your orders. Read your orders and fulfillment orders, including items, variants, SKUs, quantities, shipping method and Recipient details, to identify and fulfill the orders routed to TB3 Log.
- Fulfill them in Shopify. Update the status of those fulfillment orders and create fulfillments with the carrier, tracking number and tracking link, which marks the orders as fulfilled in your Store.
- Set up a fulfillment service, if your setup uses one. Register TB3 Log as a fulfillment service in your Store, which adds a TB3 Log location, and receive the fulfillment requests that your Store assigns to it.
- Share delivery details with carriers. Give the carrier used for each shipment (USPS, UPS, FedEx or DHL Express) only the Recipient details needed to deliver it, such as name, company, address, phone number and email. Carriers may use the phone number and email to send delivery notices.
- Share Recipients' contact details with carriers. Give each Recipient's phone number and email address to the carrier of that shipment, only so that the carrier can send delivery notifications and reach the Recipient about the delivery.
TB3 Log does not contact your customers directly. If a delivery needs attention, we contact you. We will never use Recipients' contact details for marketing or for any purpose other than the delivery of their orders.
9. Your responsibilities
- Keep the information in your Store accurate, including SKUs, order details and shipping addresses, and route to TB3 Log only the orders you want us to fulfill.
- Set up your Store's shipping, location and customer notification settings the way you want them.
- Give your customers the privacy notices, and obtain any consents, that the law requires for your Store to share their personal data with TB3 Log and the carriers and for the delivery contact described in Section 8.
- Comply with the laws that apply to your business and your products, including privacy, consumer protection, product safety, customs, export control and sanctions laws.
- Do not use the App for goods that the Service Agreement prohibits, such as illegal, hazardous or counterfeit items.
- Keep your Shopify account secure, control which of your staff can manage the App, and tell us promptly at support@tb3log.com if you suspect unauthorized use.
- Do not send us your customers' personal data by email or chat unless it is needed to solve a problem, and never send payment card details or other sensitive personal data.
10. Data and privacy
Data Processing Addendum. The DPA at https://tb3log.com/dpa is incorporated into these Terms by reference, and by accepting these Terms you also agree to the DPA. Under the DPA, you are the controller (or "business") of your customers' personal data, and TB3 Log processes it on your behalf, as your processor (or "service provider"), following your instructions. If these Terms and the DPA conflict on the processing of personal data, the DPA prevails. Our Privacy Policy explains in more detail how we handle personal data.
Data the App handles.
- Your Store: name, myshopify.com domain and contact email.
- Orders: order number, items, variants, SKUs, quantities, shipping method and fulfillment status.
- Recipients: name, company, shipping address, phone number and email.
- Shipments: carrier, tracking number and tracking link.
- Activity records: which TB3 Log team member viewed or changed each order in our internal system, and when.
How we use it. Only to provide the App and the Services to you: to receive and prepare your orders, generate shipping labels and ship, coordinate deliveries, returns and claims with carriers, send tracking information back to your Store, support you, keep the App secure and auditable, and comply with legal obligations.
Who receives it. The carriers USPS, UPS, FedEx and DHL Express, which receive only what they need to deliver; our hosting and database providers in the United States, which are bound by written obligations to protect the data; our email and messaging providers; and public authorities, when the law requires it. We send the current list of our service providers on request, and we will publish it before the App becomes publicly available on Shopify.
What we do not do. We do not sell Merchant Data or "share" it for cross-context behavioral advertising, as those terms are used in California privacy law. We do not use your data or your customers' data to train artificial intelligence or machine learning models. We do not send marketing to Recipients, and we do not make automated decisions that have legal or similarly significant effects on anyone.
Where it is processed. Merchant Data is hosted in the United States. Our operations and support team works in Brazil and accesses it remotely, with the safeguards described in Section 11. Where the GDPR or the UK GDPR applies, these transfers rely on the Standard Contractual Clauses and, for the UK, the UK International Data Transfer Addendum, incorporated by reference in the DPA. Brazil's data protection law (LGPD) may apply to the processing carried out in Brazil.
Your data. As between you and TB3 Log, you keep all rights in the data about your Store, your orders and your customers. You allow TB3 Log to use it only as described in these Terms and in the DPA.
11. Retention, deletion and security
How long we keep data.
- Recipients' personal data (such as name, address, phone number and email): up to 24 months after delivery, to handle returns, carrier claims and disputes.
- Documents for international shipments: up to 5 years, when U.S. export rules require it.
- Order records from which the Recipient's details and tracking numbers have been removed may be kept for as long as we need them for our billing, accounting and legal records.
At the end of these periods, the data is automatically deleted or anonymized.
Deletion requests, uninstallation and end of the Services. We complete deletion requests that we receive through Shopify, for a customer or for your Store, within 30 days, unless the law requires us to keep the data. If you uninstall the App, we delete the data that we received through the App within 30 days of the uninstall; Shopify sends us a deletion request for your Store 48 hours after you uninstall. When the Services end, we delete the rest of the personal data that we process on your behalf within 30 days, as described in the DPA. Data that the law requires us to keep, such as export documents, is kept only for the required period and then deleted.
Security. We protect Merchant Data with encryption in transit (TLS) and at rest, including backups; access only for team members who need it; one account per person, with a strong password and two-step verification; access logs reviewed every month; no bulk export of names and addresses; test data kept separate from production data; and an incident response plan.
Security incidents. If we become aware of an actual or suspected security incident affecting Merchant Data, we will notify Shopify within 24 hours, and we will notify you without undue delay and no later than 72 hours after confirming that the incident affects your data, in addition to any notice required by law. We will also investigate the incident, take reasonable steps to contain it and limit its effects, and keep you informed.
Access and other requests. To ask about our privacy practices, or to request a copy, correction or deletion of the data we hold about your Store or your customers, email support@tb3log.com. We respond within 30 days, or sooner where the law requires, and may ask for information to confirm your identity. On request, we provide the personal data in a structured, commonly used and machine-readable format and let you correct it. Because you control your customers' personal data, if a customer contacts us directly, we will refer the request to you and help you respond. When Shopify forwards a customer's request for their data, we provide that data to you.
12. Support
TB3 Log provides all support for the App. Shopify does not provide support for the App (see Section 5).
- Email: support@tb3log.com, for support, privacy questions and urgent issues.
- WhatsApp: +55 21 97533-7316, for calls and messages.
- Hours: Monday to Friday, 9 a.m. to 6 p.m. Brasília time (UTC−3). We aim to reply within one business day.
When you contact us, include your Store's myshopify.com domain (for example, your-store.myshopify.com), the order number and a description of what happened. Do not include your customers' personal data unless it is needed to solve the problem. More information is available on our Support page and on the App help page.
13. Changes to the App and to these Terms
Updates. We may update the App from time to time, for example to fix errors, improve security or adapt to changes made by Shopify or by carriers.
Important changes and discontinuation. If we plan to materially change the App's core functionality or features, change the data it accesses, start charging for the App or change its price or pricing structure, or discontinue the App, we will notify you by email to your Store's contact email and by a notice in the App at least 30 days in advance, whenever possible. When a change is required by law, by Shopify or to protect security, it may take effect sooner, and we will notify you as soon as practicable. If we discontinue a public version of the App, we will also follow Shopify's requirements for discontinuing apps. Discontinuing the App does not by itself end your Service Agreement.
New versions. We may ask you to replace your installation with another version of the App, for example to move from a custom app to a public app. We will tell you in advance what you need to do, and these Terms will apply to the new version. If you switch to another version of the App, the data received through the old version is deleted within 30 days of its uninstallation, as described in Section 11, and the new version receives your open orders from Shopify again.
Changes to these Terms. We may update these Terms. The "Last updated" date at the top of this page shows the current version. We will notify you of important changes in the same way and, whenever possible, at least 30 days before they take effect. Changes do not apply to disputes that arose before they took effect. If you keep using the App after a change takes effect, you accept the updated Terms. If you do not agree, you may stop using and uninstall the App before then.
14. Suspension and termination
By you. You may stop using the App and end these Terms at any time by uninstalling the App from your Shopify admin. After that, new orders no longer reach TB3 Log through the App, and the App can no longer send tracking information to your Store. Uninstalling the App does not by itself end your Service Agreement, so please contact us to agree on how to handle orders in progress.
Suspension by us. We may suspend or limit your use of the App, with notice when practicable, if: (a) you breach these Terms or the Service Agreement, including by not paying for the Services; (b) it is necessary to protect the security of the App or of Merchant Data; (c) the law, a court or a public authority requires it; or (d) Shopify suspends or restricts the App or our access to its APIs. We will restore access when the reason for the suspension no longer applies, unless these Terms have ended.
Termination by us. We may end these Terms (a) at any time, with at least 30 days' notice, for example when we discontinue the App; or (b) immediately, by notice, if you materially breach these Terms, use the App unlawfully or put the security of the App or of Merchant Data at risk. These Terms also end automatically when your Service Agreement ends, unless we agree otherwise in writing.
What happens next. When these Terms end, your license ends and you must uninstall the App if it is still installed. We stop receiving new orders through the App and delete data as described in Section 11. Amounts owed for the Services remain due under the Service Agreement. Sections 5, 10, 11, 15, 16, 17, 18 and 19, and any other provision that by its nature should continue, survive the end of these Terms.
15. Disclaimers
The App is provided "as is" and "as available". To the maximum extent permitted by law, TB3 Log disclaims all warranties relating to the App, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the App will be uninterrupted, error-free or free of harmful components, or that it will meet all of your requirements.
The App depends on services that we do not control, including Shopify, the carriers, our hosting providers and the internet. We are not responsible for their availability, changes, errors or decisions, including carriers' delivery times and the tracking updates they provide. Our commitments about the Services, such as the care we take with your goods, are set out in the Service Agreement, and this Section does not reduce them.
16. Limitation of liability
To the maximum extent permitted by law, TB3 Log will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising out of or relating to the App or these Terms, even if we were advised that such damages were possible. TB3 Log's total liability for all claims arising out of or relating to the App or these Terms is limited to the greater of US$100 and the fees you paid to TB3 Log under the Service Agreement in the 3 months before the event that gave rise to the claim.
Claims about the Services, including the handling, storage and shipping of your goods and their loss or damage, are governed by the limitations in the Service Agreement, and this Section does not increase them. TB3 Log's liability under the DPA is subject to this Section, except where data protection law does not allow it. Nothing in these Terms limits liability for fraud or willful misconduct, or any other liability that cannot be limited under applicable law. These limitations apply to TB3 Log's liability to you and do not make Shopify liable for anything.
17. Indemnification
You will defend, indemnify and hold harmless TB3 Log, Shopify, their affiliates and their respective directors, officers, employees and agents from and against any third-party claim, and any related losses, damages, fines, costs and reasonable attorneys' fees, arising out of or relating to: (a) your breach of these Terms; (b) your products, your Store, or the order information and instructions you provide, including inaccurate addresses and prohibited goods; (c) your violation of any law or of anyone's rights, including any failure to give the notices or obtain the consents needed to share your customers' personal data with TB3 Log and the carriers; or (d) your relationship with your customers. This does not apply to the extent that a claim results from TB3 Log's breach of these Terms, the DPA or the Service Agreement, or from TB3 Log's negligence or willful misconduct.
The party seeking indemnification will notify you promptly of the claim. You may control the defense, and that party may take part with its own counsel at its own expense. You may not settle a claim in a way that admits fault by, or imposes an obligation on, TB3 Log or Shopify without their prior written consent.
18. Governing law and disputes
These Terms, and any dispute arising out of or relating to them or to the App, are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Miami-Dade County, Florida, have exclusive jurisdiction, and both parties submit to their jurisdiction. This does not apply where the data protection law that governs the processing of personal data requires a different governing law or forum. If you have a concern, please contact us first at support@tb3log.com so we can try to resolve it.
19. General
- Entire agreement. These Terms, including the DPA, together with the Service Agreement, are the entire agreement between you and TB3 Log about the App and replace any earlier understanding about it.
- Independent parties. You and TB3 Log are independent contractors. These Terms do not create a partnership, joint venture, agency or employment relationship.
- Assignment. You may transfer these Terms to a successor of your Store or business who accepts them, with notice to us. Any other transfer requires our written consent, which we will not unreasonably withhold. We may transfer these Terms to an affiliate or to a successor of our business, with notice to you.
- Events beyond control. Neither party is liable for a delay or failure caused by events beyond its reasonable control, such as outages of Shopify, carriers, hosting providers or the internet, natural disasters or government actions.
- Notices. We send notices to your Store's contact email or to the email address in your Service Agreement. You can send notices to support@tb3log.com.
- Severability and waiver. If a provision is found unenforceable, it is limited to the minimum extent necessary and the rest of these Terms remains in effect. Not enforcing a provision is not a waiver of it.
- Third parties. Except for Shopify, as stated in Section 5, and the other persons protected by Section 17, these Terms do not give rights to anyone other than you and TB3 Log.
- Language. These Terms are written in English. If they are translated, the English version prevails.
